Stipendiary Steward Mr J P Oatham asked the Committee to consider a breach of Rule 520 (4) (c) by jockey P Cunningham who had been engaged to ride HARLECH in race 4. Mr Cunningham admitted the breach.
--Mr Oatham informed the Committee that Mr Cunningham had been engaged to ride HARLECH at 63 kgs, less 3 kg allowance which he was able to claim. On arrival on the course Mr Cunningham informed the connections of his mount that he would be 1.5 kgs over his entitled weight. This was not acceptable and Mr Cunningham was duly replaced.
--Mr Oatham said that this was Mr Cunningham's first charge under this Rule and asked for a fine in the $100 - $200 range.
--Mr Cunningham had nothing to say.
--After considering all the facts, including that this is Mr Cunningham's first charge under this Rule, we impose a fine of $150.
