Following race 3 an information was filed pursuant to Rules 857 (3) and 858 (3) when Stipendiary Steward Mr J P Oatham alleged that Mr P Ormsby, rider of SAKURA THE CASH weighed in at 68.5 kg being 1.5 kg less than his weigh out weight
Following race 3 an information was filed pursuant to Rules 857 (3) and 858 (3) when Stipendiary Steward Mr J P Oatham alleged that Mr P Ormsby, rider of SAKURA THE CASH weighed in at 68.5 kg being 1.5 kg less than his weigh out weight.
--Mr Ormsby, who admitted the offence, was represented by Mr K Myers.
--Mr Oatham outlined the charge that found Mr Ormsby weighing in 1.5 kgs light. He said that the horse was favourite for the race and it was perhaps fortunate that it did not finish in a place as it is under Rule 857 (3) mandatory that the horse be disqualified.
--Mr Oatham showed the lead bag, which was in poor repair, but did say that Mr Ormsby assured him that no lead was put in the pouches that had faulty stitching in them. He said that there was doubt as to how the lead was lost. It was possible that it was never put in the bag.
--In asking for a fine in the $250 - $350 range Mr Oatham emphasised the seriousness of possible consequences of the offence.
--Mr Myers, for Mr Ormsby, said he doubted if his rider would have the ability to pay a fine because of his financial and work situation. He did suggest that his lead bag could be confiscated and that, in his opinion, would be sufficient.
--PENALTY
The Committee, in coming to their decision on penalty, expressed concern that a trainer of Mr Myers' experience should saddle a horse using a lead bag that was obviously in need of repair.
--We accept that this is a serious offence that could have had serious consequences for bettors if SAKURA THE CASH had finished in a dividend bearing place. The horse SAKURA THE CASH is disqualified from the race. Mr Ormsby is fined $250 and we ask Mr Myers to assist Mr Ormsby in making arrangements with the Racecourse Inspector to organise payment of the fine.
