Decision: Following race 2 an information was lodged by Stipendary Steward Mr J C Oatham pursuant to rule 871(1)(d) when he alleged that nearing the 150 metres J McDonald (THE PONY EXPRESS) allowed his mount to shift in when not clear
Following race 2 an information was lodged by Stipendary Steward Mr J C Oatham pursuant to rule 871(1)(d) when he alleged that nearing the 150 metres J McDonald (THE PONY EXPRESS) allowed his mount to shift in when not clear of CONCINNITY (M Walker ) who had to check. GIBBES (D Johnson) was also crowded in this incident.

Mr McDonald, who was represented by his employer Mr B McDonald, did not admit the charge.

Mr A Cole demonstrated the videos. He showed that after entering the straight Miss D Johnson on GIBBES was on the rails. Outside her was M Walker on CONCINNITY and further out was J McDonald on THE PONY EXPRESS.

THE PONY EXPRESS began an inward movement and continued on the same angle until it took the line of CONCINNITY who was forced across on to GIBBES. At no time could THE PONY EXPRESS be seen to be clear of CONCINNITY who had to be checked out by it’s rider. Mr Cole showed where, in his opinion, Mr McDonald had moved 1 –1 ½ horse widths.

Miss Johnson explained how she had received pressure from the outside.

Mr Walker explained how he had received pressure from Mr McDonald and eventually had to check his mount. He said he was always entitled to be in his position and that he was within a length of THE PONY EXPRESS.

In answer to Mr B McDonald he said that the movement and pressure was gradual.

Mr B McDonald, in defense of his apprentice, claimed that the video showed at the 150 metre mark THE PONY EXPRESS had moved in very little. He said that his horse was only having his 2nd start. He raced greenly and the track was softer than the one he had previously run on and this had caused him to hang in. He questioned the amount of sideways movement that it had been claimed he moved. He showed where, after the incident, J McDonald had managed to turn the horses head out and take the pressure off the inside runners.

Mr Oatham, in summing up, said that in his opinion there had been excessive sideways movement by THE PONY EXPRESS and at no time during the movement had Mr McDonald stopped riding his mount forward.

DECISION:

After reviewing the videos and other evidence the committee prefer Mr Oatham’s evidence. They agree that during the sideways movement, which was in excess of 1 horse width, Mr McDonald continued to ride out his mount when taking the line of CONCINNITY when not sufficiently clear.

PENALTY:

Mr Oatham informed the committee that Mr McDonald had commenced riding at the start of the racing season and that he was a very successful rider who was presently 2nd in the Apprentice Premiership and this was his 1st charge. He did say that he felt the offence warranted a suspension and asked for 4 – 5 days.

Mr McDonald asked that any suspension not start till after 22 Feb.

After due consideration and taking into account the level of interference and Mr McDonald’s record we suspend him from the conclusion of racing on 22 February till the finish of racing on 28 February 2008. (4 days)
