Following Race 7 an Information was filed pursuant to rule 520 (4) (c). The Informant, Mr J Oatham, alleged that Mr Ihaka failed to make the carded weight for QUARTZE (Race 7) and DRAMATIC DUCHESS (Race 9).

Following Race 7 an Information was filed pursuant to rule 520 (4) (c). The Informant, Mr J Oatham, alleged that Mr Ihaka failed to make the carded weight for QUARTZE (Race 7) and DRAMATIC DUCHESS (Race 9).
--Mr Ihaka admitted the breach.
--Mr Oatham said both the horses in question had 64 kilos and Mr Ihaka could only make 65 kilos.
He was replaced in both races.
Mr Ihaka had nothing to say except that it was laziness on his part.
--PENALTY SUBMISSIONS
--Mr Oatham said this was Mr Ihaka’s third breach of this rule since 10 June 09 and as 2 horses were effected submitted a fine of $200 - $250 would be appropriate.
--PENALTY
--The Committee took into account all evidence and submissions. Because this was Mr Ihaka’s third offence under the weight rule since June and the fact that he had to be replaced on 2 horses, an increased penalty from those 2 offences needed to be imposed. In mitigation Mr Ihaka did plead guilty.
--Accordingly we impose a fine of $250.
