This charge arises from the running of race 5, the Rotorua District RDA – Flair Amateur Riders Series. Stipendiary Steward Mr Jones filed an Information pursuant to Rule 638(3)(b)(ii) alleging that Class E Rider Mr Isdale used the whip excessively on his mount TOORAK TOWER prior to the 100 metres.
Mr Isdale acknowledged he understood the nature of the charge; the relevant Rule and he confirmed his admission of the breach.
Rule 638(3)(b)(ii) provides that a Rider shall not:
(ii) strike a horse with a whip in a manner or to an extent which is excessive
The “Guidelines with Respect to Acceptable Use of the Whip” provide:
Without affecting the generality of Rule 638(3) (b) a rider may be penalised if their whip use is outside of the following guidelines:
Inside the final 600 metres of any Race, official trial or jump-out a horse may be struck with the drawn whip up to five times after which the rider must cease their use of the whip for a minimum of five strides before striking the horse again with the drawn whip, with this restriction to apply prior to the final 100 metres. The whip may then be used at the rider’s discretion until the winning post is reached.
Prior to the final 600 metres of a race, official trial or jump-out the use of the drawn whip is acceptable if used in moderation and not continually.
Using available video footage Mr Jones demonstrated that Mr Isdale used his whip 13 times from just prior to the straight entrance to the 100 metre mark. He said that the strikes were not particularly forceful and a number were on the shoulder. He added they were without the necessary respite and outside the use of whip guidelines which require minimum respite of 5 strides.
In response, Mr Isdale said that he had nothing further to say in relation to the breach.
Submissions for Penalty:
Mr Jones produced Mr Isdale’s record which showed no previous breaches under this Rule in the last 12 months. On that basis he submitted he has a good record. He further submitted that the number of strikes was approaching the high range, but reiterated they were not forceful. He further submitted that amateur riders generally receive a discount, but would leave any decision as to discount for the Committee to determine.
Mr Isdale offered no submissions in relation to penalty.
Reasons for Penalty:
The Committee considered all the evidence and submissions presented. After reviewing the race films, we identified Mr Isdale’s mount as the widest runner into the home straight. We observed that he struck his mount 13 times from the straight entrance to just prior to the 100 metres. The Committee noted that his mount was well tried and it did not appear to be responding to Mr Isdale’s urgings. We would generally afford an amateur rider some discount due to their status. However, on this occasion, although we accept the strikes were not forceful or continuous, we do question whether they were necessary under the circumstances, given his mount was under a hard rise and simply not responding.
The JCA Penalty Guide establishes the starting point for (first, second, or third) breaches of Rule 638(3) (b) (ii) as follows:
1st breach $300
2nd breach $500
3rd or subsequent breach 6-8 national riding day suspension
After taking into account all the above factors we do not afford Mr Isdale any discount due to his amateur status. Given this was Mr Isdale’s first breach within 12 months, the Committee considers a $300 fine is appropriate.
