Decision:

After viewing the videos and considering the evidence of the Stewards, Mr Dunn and Mr Beck we are not satisfied that Mr Williamson drove in a manner which was careless.

The charge is dismissed.

Charge:

Following the running of Race # 6 the SBS Bank – Winning Lending Offer Mobile Pace, Stipendiary Steward, Mr SP Renault lodged an Information alleging Mr B Williamson (Pay Me Quick) drove carelessly on the final bend resulting in interference to Percius (D Dunn), Royal Sue (NP Williamson), Rogart (JW Cox) and My Guy Mac (C Ferguson).

On being served with the Information Mr Williamson did not admit the charge and appeared at the hearing with senior horseman Mr AR Beck to assist him.

Facts:

With the assistance of the video replay Mr Davidson pointed out the relevant positions of each horse.

Mr Renault alleged that just inside the 300m mark PAY ME QUICK was racing approximately three back on the one-out line with PERCIUS on his outer and ROYAL SUE behind PERCIUS. ROGART was further back and wider with MY GUY MAC behind it. He stated Mr B Williamson shifted outwards on PAY ME QUICK forcing PERCIUS outwards sharply. This forced both Mr Dunn (PERCIUS) and Mr N Williamson (ROYAL SUE) to take a hold of their horses due to the interference. He alleged this movement set of a concertina affect with ROYAL SUE being shifted wider onto ROGART resulting in MY GUY MAC locking wheels with ROGART on its inside. Both the latter horses losing their chances.

Mr Renault called Mr Dunn to give evidence on behalf of the Stewards.
Mr Dunn stated his horse was on the outside of PAY ME QUICK. He was on the retreat when Mr Williamson shifted outwards. He said it appeared PAY ME QUICK had run outwards wider than Mr Williamson had intended. He did not feel he was checked that badly.

Mr Beck stated that he believed the incident was in fact two separate incidents and not solely attributed to Mr Williamson. He did not believe Mr Williamson’s outwards movement was sharp or careless or resulted in ROGART and MY GUY MAC locking wheels. He believed MY GUY MAC had in fact locked wheels with ROGART on its inside when attempting to improve wider on the track. He said that just prior to the two horses locking sulky wheels Mr Cox had turned his horses head inwards away from the outside runner.  

Reasons for Decision:

The Steward, Mr Renault alleges that Mr Williamson’s sharp outwards movement set off a chain reaction resulting in ROGART and MY GUY MAC locking wheels on the extreme outside. His main witness Mr Dunn stated that while he did take a hold of his horse (PERCIUS) he was on retreat and the check wasn’t that bad. Mr Beck, on behalf of Mr Williamson, stated he felt the incident was in fact two separate incidents and not solely due to the driving of Mr Williamson.

We accept that Mr Williamson did shift outwards requiring both Mr Dunn and Mr N Williamson to take a hold of their horses and race wider on the track. However, the committee does not believe that in itself is sufficient to uphold the charge. We are also not convinced that Mr Williamson's driving was the main factor in ROGART and MY GUY MAC locking wheels on the extreme outside.
