At the conclusion of Race 4, The Dagwood Dagging/Hecton Products Mobile Pace, an information (66878) was lodged by Stipendiary Steward Mr  CJ Allison alleging under Rule 869 (2)(A) that AJ Suddaby, the driver of SON OF GENA used his whip excessively over the final stages.

At the conclusion of Race 4, The Dagwood Dagging/Hecton Products Mobile Pace, an information (66878) was lodged by Stipendiary Steward Mr  CJ Allison alleging under Rule 869 (2)(A) that AJ Suddaby, the driver of SON OF GENA used his whip excessively over the final stages.

The Rule reads 869 (2)(A):

--

No horseman shall during any race … use his whip in an unnecessary, excessive or improper manner.

--

Mr Suddaby admitted the breach.

--

Stipendiary Steward Mr CJ Allison, used several video clips of the alleged incident, highlighting Mr Suddaby commencing using his whip from the 400 metre mark to the winning post on twenty nine occasions.

Mr Suddaby did not dispute any of the evidence presented, stating that he was very frustrated at his horses disappointing performance.  Mr Suddaby stated he trained the horse and he knew it could do better.

DECISION

--

The committee was satisfied a clear breach of the Rule had occurred, and as a result the charge was found  proven.

SUBMISSIONS ON PENALTY

--

Mr Allison stated that Mr Suddaby had not had a breach under this Rule in the past twelve months, and that he was seeking a monetary penalty.

--

In considering penalty, Mr Suddaby’s guilty plea and unblemished driving record over the past twelve months were taken into account.

--

Mr Suddaby was fined the sum of $250.00
