Facts:
Following the running of race 9 The Locations Fillies & Mares Mobile Pace a protest was lodged pursuant to rule 869(8).
Stipendiary Steward Mr Ydgren alleged that the third placed horse by the judge Simply Genius (C J Barron) hung in checking Pinot Gris (N Williamson) resulting in Pinot Gris galloping when racing past the 1400 metre mark.
Judges placings were :
1st- Pennsylvania (D Dunn)
2nd- Bub's Hanover (C Hanna)
3rd- Simply Genius (C Barron)
4th- Twilight Jaccka (B Barclay)
5th- Heres Hoping (R Swain)
6th- Riverboat Gracie (R Hayter)
Submissions for Decision:
Mr Ydgren identified the horses involved in the protest outlining the incident using all of the available video angles and clips.
Mr Ydgren stated that Mr Barron (Simply Genius) had shifted down onto Mr Williamson's horse (Pinot Gris) causing some tightness and lack of racing room with Mr Williamson's horse breaking and settling at least 15 lengths from the last horse effectively losing all chance.
Mr Williamson stated there was some tightening and that contact had been made by Mr Barron's horse causing his horse to break.
Mr Williamson stated that in no way did his horse contribute to the incident.
Mr Barron agreed there had been slight interference but stated that there had been a general tightening and that he had been in similar situations when no incident had occurred.
Reasons for Decision:
The Committee carefully considered all of the evidence and reviewed all of the video angles of the incident.
We were satisfied that Mr Barron (Simply Genius) had caused the tightening to Mr Williamson's horse (Pinot Gris) when racing past the 1400metre mark. It was our opinion that the interference although only slight in the contact that was made, caused Pinot Gris to break, and effectively lose its chance to run in a stake bearing place.
