FACTS:

--

Following Race 6 an information was filed pursuant to Rule 638 (3) (b).  The informant, Mr McLaughlin, alleged that Mr J Bates (Jockey) had used his whip excessively between the 400 metres and the 200 metres.

Mr Bates admitted the breach.

--

 

--

Mr McLaughlin stated that Mr Bates had struck his mount between 10 – 12 times.  Mr Davidson used video films which clearly showed Mr Bates striking the horse ORLOV as previously stated.

Mr Bates, in admitting the breach, said that his mount was a ‘one pacer’ and that his actions resulted in the horse winning the race.  

--

Mr McLaughlin confirmed that this could well have been the case.

--

SUBMISSIONS ON PENALTY:

--

Mr McLaughlin stated that Mr Bates had no previous breaches under this Rule and that the Committee might take into account the fact that the race carried a Maiden stake and that in his opinion the breach was at the lower end of the scale.  Mr McLaughlin suggested a fine in the range of $100 - $200.

DECISION / REASONS:

--

The Committee considered all evidence before imposing an appropriate penalty.  This was Mr Bates’ first charge under this Rule and he has admitted the breach.  The Committee determined that the penalty be at the lower end.

--

PENALTY:

--

Accordingly the Committee imposed a fine of $150.

--
