Charge:

At the conclusion of race 7 an information was lodged by Stipendiary Steward Mr M Davidson alleging that Mr T Yeo (Licensed Person)mounted and rode 'Lindisfarne' without a body protecter and skull cap as required under the rules.
 
Rule 610(2)(a)(b) states:- A rider shall when mounted on a horse wear a properly fastened body protector of a type and standard approved by NZTR ,which shall be in a satisfatory condition and shall have attatched to it a manufacturers label that states that it complies with the relevant type and standard approve by NZTR;and a skull of a type and standard approved by NZTR. 

Facts:

Stipendiary Steward Mr Davidson stated that Mr Yeo had captured the horse 'Lindisfarne' at the straight entrance and rode the horse back to the fence where it fell and completed the course without a body protector and skull cap.
 

Submissions for Decision:

Mr Yeo stated that he had heard lot's of yelling and screaming and there was some confusion. He saw another fallen horse being mounted and decided to do the same.

Reasons for Decision:

The committee was satisfied a breach of the rule had occurred and that Mr Yeo did in fact ride the horse without a body protector and skull cap. 

Submissions for Penalty:

Mr Davidson stated that this was Mr Yeo's first offence under this breach and that a fine in the range of $200-300 was appropriate.

Reasons for Penalty:

In determining penalty the committee took into account Mr Yeo's admittance of the breach and his open and honest manner.
