As Mr Mudhoo has admitted the breach, we find the breach proved.

Penalty:

Mr Mudhoo is suspended from the end of racing on 19 April up to and including 3 May. This is 11 National days.

Facts:

Following the running of Race 1, the TODD & CO REALTY & INSURANCE BROKERS ALLIANCE HANDICAP, an information was filed by Stipendiary Steward, Mr Davidson, against Mr Mudhoo, alleging careless riding in that he allowed his mount CIVIC RECEPTION to shift outwards near the 250 metres when not sufficiently clear of SHIRLEY MAUDE which was crowded and checked, with FULLTOTHE BRIM being hampered as a consequence.

Mr McLaughlin demonstrated on the films that Mr Mudhoo’s horse had started to lay in in the straight and Mr Mudhoo had taken the necessary corrective action. However, he had then allowed his horse to lay out and this had put Mr Moseley in tight quarters and he had to check his mount. Mr Mudhoo was drifting outwards on the track and had not straightened his mount. He still had the stick out. He came into contact with Mr Laking whose horse was turned sideways.

Mr Mudhoo said his horse had been lugging in and he had corrected it. His horse had then shifted out. When questioned by the Committee, he said he was not aware that it was shifting.

Mr Walsh said the respondent had corrected the initial movement. But the more Mr Mudhoo tried to ride the horse out, the more the horse kept shifting. He agreed Mr Moseley had been affected by Mr Mudhoo’s actions but he believed Mr Moseley’s horse was hanging prior to this. He said Mr Moseley had been trying to get into the gap between Mr Laking and Mr Mudhoo but was not able to do so because his horse would not go straight and take the gap. He said Mr Moseley had his head in the gap and had been “the meat in the sandwich”. He also believed Mr Laking had moved in just a little prior to the incident.

Submissions for Penalty:

Mr Davidson produced the respondent’s record, which evidenced five previous breaches of this rule since November 2017, including one earlier in the race in question. He said this was very disappointing as Mr Mudhoo was a very capable rider and had won the Riverton Cup today. He emphasised Mr Mudhoo had an obligation to straighten his mount. He had done so the first time but had kept hitting his horse as it was shifting out. In Mr Mudhoo’s favour, he said, was the fact that the horse had not moved out a lot.

Mr Davidson described the breach as mid to high range.

Mr Walsh said he had nothing to add concerning the nature of the breach but said, as had Mr Davidson, that Mr Mudhoo should be given credit for admitting the breach.

Reasons for Penalty:

The starting point for a high end breach is 10 days. We believe the breach is at the low end of high and take a 10-day starting point. Mr Mudhoo has shifted wider on the track and has placed two jockeys in difficulty. Mr Moseley has had to take a strong hold and there was firm contact with Mr Laking’s mount. All the while Mr Mudhoo has been hitting his horse.

We do not add to the two-day uplift for previous record we gave when imposing penalty for the earlier breach in this race, although we believe we would have been entitled to do so. We give a one day deduction for admission of the breach.

This leaves us with a penalty of 11 days’ suspension.
