The Committee advised that Mr Johnson would ride FIORANO in the Riverton Cup.

Facts:

Prior to the commencement of race 1 at the Riverton Racing Club an information was lodged by Stipendiary Steward Mr M Davidson asking the Judicial Control Authority under rule 902(1) to determine whether rider C W Johnson has an engagement for THE GLITZY ONE or FIORANO.

The rule reads 902(1):

The Judicial Committee shall have jurisdiction to determine all proceedings commenced pursuant to these rules, which are not expressly stated by any of these rules to be within the jurisdiction of any other person or body.

Submissions for Decision:

Mr N Coulbeck the trainer of FIORANO stated that the horse had been brought down from the North Island 6 weeks ago, specifically with racing in the Riverton Cup as its target. Miss Middlewood had been assisting Mr Coulbeck working horses at the beach, and at this time the first discussion of Mr Johnson riding FIORANO in the Riverton Cup was discussed.

Mr Coulbeck said it was a tentative engagement, however two weeks ago a telephone conversation took place where Miss Middlewood confirmed Mr Johnson would be riding the horse.

Mr Coulbeck stated that he had no issues with Miss Middlewood or Mr Johnson and he knew they were only trying to be helpful, but he always understood Mr Johnson was riding the horse.

Mr Tony Dennis a part owner of THE GLITZY ONE stated that on the 9th of March he and Mr Steve Anderton (Trainer of THE GLITZY ONE) asked Mr Johnson at Wingatui races if he would ride THE GLITZY ONE in the Riverton Cup.

Mr Johnson said he would have to see ‘Belinda’ (Middlewood).

On Monday 25th March Mr Dennis understood there was a discussion between Miss Middlewood and Mr Anderton, with Miss Middlewood saying that Mr Johnson could ride THE GLITZY ONE as Mr Coulbeck's horse would not be starting due to the firm track.

Miss Middlewood stated that she had been helping Mr Coulbeck since Christmas at the beach and was aware that FIORANO was being set for the Riverton Cup.

Miss Middlewood said that at this time she accepted the ride for Mr Johnson on the horse.

Miss Middlewood stated that she thought the horse needed a wet track, as its record showed it had never won on a good track but had been placed.

Last Saturday at Riccarton Mr Johnson was offered the ride on THE GLITZY ONE however he did not accept on this day.

Miss Middlewood on Monday 25th March checked and saw that Riverton was a good track and assumed that FIORANO would be scratched but she did not cross check with Mr Coulbeck.

When speaking to Mr Anderton she was surpised that the ride on THE GITZY ONE was still available and she confirmed Mr Johnson would like to ride the horse.

Not surprisingly Mr Anderton and Mr Dennis from that time thought Mr Johnson would ride the horse in the Riverton Cup.

Reasons for Decision:

This chronology of events satisfied the Committee that a firm commitment had been given by Miss Middlewood to Mr Coulbeck that Mr Johnson would ride his horse FIORANO in the Riverton Cup.

It was clear, confusion surrounded Miss Middlewood and her recollection of events and that she regarded that the state of the Riverton track had determined her decision making.

By her own admission and words she said that she had made a mess of the riding engagements for Mr Johnson in the Cup as she had clearly engaged Mr Johnson for both horses.
