Following the running of race 5 the Waiau Hereford Stud/Mrs Parker’s Cafe Maiden a Protest information was filed by the connections of the fourth placed horse Good Bye Senorita against the third placed horse Parker alleging interference about the 75m, which cost Good Bye Senorita a chance of finishing in a better position. The official margin at the finish was a nose.

Rule 642(1) reads:
If a placed horse or its rider causes interference within the meaning of this Rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred they may place the first mentioned horse immediately after the horse interfered with.

Mr Johnson stated he was getting a clear run up the home straight (wide out) and was making good ground on the leaders. He stated Parker (Miss Wynne) rolled out and its hind quarter came into contact with the shoulder of his horse. At that point he was a half to three quarters of a length back. This forced his horse to shift outwards and lose momentum for a stride. He had to straighten his horse and was making ground on the other horse at the finish.
Mr Muldrew confirmed Mr Johnson’s comments but also added the interference cost his horse a chance of finishing in a better position.
Miss Wynne stated her mount was tiring in the straight. Her mount changed stride and shifted outwards making slight contact with Good Bye Senorita. She did not draw the stick on her horse as she was confident she had the other horse well covered.
Mr Davidson said Good Bye Senorita was taken off its line by a length when Parker shifted outwards and made contact. Up until then Good Bye Senorita was making ground on Parker. The margin at the finish was a nose.
Reasons for Decision:
The committee is satisfied that Miss Wynne allowed her mount Parker to shift outwards and make contact with Good Bye Senorita with approximately 75m to run. At the point of contact Good Bye Senorita was a half to three quarters of a length back and improving. Mr Johnson was forced to correct his mount and in doing so lost momentum (briefly). Good Bye Senorita finished on strongly and was beaten a nose at the finish by Parker.
We find that the interference by Parker to Good Bye Senorita at the 75m affected Good Bye Senorita’s chances of finishing in a better position at the finish. The committee exercises its discretion under the rule and the protest is upheld.
