Mr Campbell admitted the charge and it is found proved.

Penalty:

Mr Campbell is fined the sum of $200 and is suspended from the end of racing on 10 April up to and including 18 April. He is reminded of his obligations under the Rules.

Facts:

The Stewards charged Mr Campbell with a breach of r 638(3)(b)(ii) in that he used his whip excessively prior to the final 100 metres.

Miss Haley demonstrated on the video that the Respondent struck his mount 10 times before the final 100 metres of the race.

Mr Campbell said the horse was lazy and he had lost count after 3 or 4 strikes. He said he was aware he was going to be in the finish and had got over-excited. He recognised this was no excuse and he had simply made a misjudgement.

Mr Walsh said the Respondent’s mount was full of running and the Respondent had been caught out by the long Riverton straight.

Submissions for Penalty:

Mr Davidson produced Mr Campbell’s record which showed one breach in the past six months. He said Race 8 was a Listed race, the number of strikes was 10, and the Respondent had finished second. He submitted a fine which reflected Mr Campbell’s riding fee and a suspension of 6 or 7 days was the appropriate penalty.

Mr Walsh said the Respondent had a very good record with only the one breach in the last six months. He said the strikes were broken up and Mr Campbell had got over-excited.

Mr Campbell asked for a deferment until after Riccarton next Saturday. The Stipendiary Stewards had no objection to this.

Reasons for Penalty:

Mr Campbell has a previous breach of this Rule in the past six months and has admitted the breach. The penalty needs to reflect the fact that there were 10 strikes and that this is a Listed race. The fine needs to remove the bulk of Mr Campbell’s riding fee.
