Following Race 9, under Rule 871 (1) (d) an information was filed by Stipendiary Steward Mr S C Ching against Mr D Skerrett, rider of BARNEY'O in that with approximately 100 metres to race Mr Skerrett moved inwards when insufficiently clear,
Following Race 9, under Rule 871 (1) (d) an information was filed by Stipendiary Steward Mr S C Ching against Mr D Skerrett, rider of BARNEY'O in that with approximately 100 metres to race Mr Skerrett moved inwards when insufficiently clear, causing CROWDED HOUSE, no. 9 ridden by C Spittles, to check and change ground.
--Stipendiary Steward Mr Lawson used video film to demonstrate the alleged breach. The panel viewed the incident using 'front on' and 'side on' shots.
--Mr Skerrett also used the film - explaining that whilst he admitted the offence - he pointed out that it was well known that BARNEY'O had a reputation for lugging in and that he was a difficult horse to ride. He also stated that he thought that he was clear of CROWDED HOUSE, but when viewing the film he agreed that an error of judgement had been made.
--Before deciding on penalty the Panel was informed that Mr Skerrett had recently had a similar charge proven against him and that he was about to serve a 3 day suspension. His record for the previous 12 months, with that one exception, was excellent.
--After some deliberation the Panel decided to suspend Mr Skerrett for a further 3 riding days. This suspension would be for up to and including racing on 23 November 2007. The Panel also informed Mr Skerrett that any further transgressions of this type would be treated very severely.
--When deciding penalty the Panel took into account the following factors :

- Early guilty plea. --
- Riding record. --
- Were mindful that 2 of the days of suspension are 'Premier' days in Christchurch. --
- Stipendiary Stewards considered the incident 'mid-range' (Mr S Ching). --
- That this was a second offence in a short time frame.
