As Mr Lowry admitted the breach we found the charge proved.

Penalty:

We grant Mr Lowry’s request to seek a deferment to his suspension as per rule 1106(2).

Accordingly Mr Lowry is suspended from the conclusion of racing on Saturday 2nd April 2016 until the conclusion of racing on Saturday 9th April 2016. (Effectively 2 South Island days).

Southland meeting on the 9th April 2016.

Facts:

Following the running of Race 7, the Elmwood Catering Pourakino Handicap, an information A7771 was lodged by Mr M Davidson under rule 638(1)(d) in that apprentice jockey J Lowry allowed his mount (Centavada) to shift out near the 450 metre mark when not clear of Mr Nobody (R Cuneen) which clipped a heal and blundered.

Stipendiary Steward Mr Coles used the video to highlight the incident. Mr Lowry was travelling back on the fence and was pushing forward. Passing the 450 metres Centavada (J Lowry) was angled out off the heels of Carlton Princess and as a result checked Mr Nobody.

Mr Coles noted that Centavada had hung on every corner in this race, which was demonstrated on the video clips.

Mr Lowry stated that his horse was not an easy horse to ride and that he had made a simple error of judgment of coming out too soon. He also stated although he had ridden the horse in its previous start it did not hang on that occasion. He also stated it was entirely his fault and responsibility to ride properly and be safe.

The rule reads: 638(1)(d):

A rider shall not ride a horse in a manner which the Judicial Committee considers to be (d) careless.

Submissions for Penalty:

Mr Davidson submitted that Mr Lowry had incurred suspensions for careless riding twice in the previous 12 months. On April 22nd 2015 he incurred a 2 day suspension at the Otago RC and then again on 4th December 2015 at the North Canterbury meeting he received a further 2 days. Both suspensions were at the low end of scale of carelessness.

Mr Davidson submitted that Mr Lowry was a very busy, successful apprentice jockey and had nearly 300 rides this season. In relation to today’s breach Mr Davidson said the Stewards believed that a suspension was the appropriate penalty but placed the severity of the breach at the low end and he recommended a 2 day suspension was appropriate.

Reasons for Penalty:

In coming to a decision on penalty the Committee adopted, as a starting point a 3-day suspension as outlined in the penalty guide for Judicial Committees for South Island riders. Mr Lowry clearly has made a simple error of judgment and has moved outwards when not sufficiently clear of Mr Nobody who has clipped heels and blundered.

In fixing penalty we took into account that, Mr Lowry is a very successful Apprentice Jockey and the degree of carelessness was at the lower end.

Also his early and frank admission of the breach, and his record which we considered to be good.
