The committee was satisfied that a clear breach of the rule had occurred with the inwards movement of JAYLAH causing FLYING TAP to be checked.
Penalty:
Mr Muniandy was suspended from race riding from the conclusion of racing on Monday 25th April 2011 until the conclusion of racing on Sunday 1st May 2011 effectively two South Island riding days.
Charge:
At the conclusion of race 9 the Elmwood Catering Gallop South Derby an information was laid by Stipendiary Steward Mr M Davidson under rule 638(1)(d) alleging that apprentice jockey S Muniandy the rider of JAYLAH permitted his mount to shift inwards when not clear of FLYING TAP causing that horse to check. The incident occurring at the 1750 metre mark.
Mr Muniandy admitted the breach and was represented in the hearing by his employer Mr B Anderton.
Facts:
Stipendiary Steward Mr Davidson showed the committee several video clips of the alleged incident (head on and side on) clearly identifying the inwards movement of JAYLAH onto FLYING TAP.
Submissions for Decision:
Mr Anderton stated that the horse JAYLAH experienced and racing greenly and that Mr Muniandy had made an error of judgement in coming across too soon to slot into a good position over the long distance race.

Stipendiary Steward Mr Davidson stated that Mr Muniandy is a busy apprentice jockey who had been riding very successfully. Mr Davidson also stated that Mr Muniandy had one previous breach under this rule in the past 12 months at the Wingatui meeting in December 2010 where he received a three day suspension.
Mr Anderton confirmed Mr Muniandy’s recent riding successes and also stated that Mr Muniandy had also recently ridden a group one winner at the Canterbury Jockey Club. Mr Anderton also stated that he thought the breach was not major and was an error of judgement that Mr Muniandy had made at almost the outset of the race.
Reasons for Penalty:
In fixing penalty the committee took into account Mr Muniandy’s early admittance of the breach and also the fact that the Committee considered the breach to be at the low end of the scale of carelessness.
Further consideration was also given to Mr Muniandy’s excellent riding record.
