At the conclusion of Race 5, the Richard Hishon Builder and Travellers Rest Tavern 1400, an Information (5540) was lodged by Stipendiary Steward Mr M Davidson, under Rule 638 (1) (d).

Mr Davidson alleged that A Mundy, the rider of The Star Gazer, allowed her mount to shift in when not clear causing Surprise Purchase (L Robinson) to check near the 1000 metre point. Miss Mundy admitted the breach and was present at the hearing. Stipendiary Steward Mr McLaughlin used several video clips of the alleged incident, highlighting the movement inwards from The Star Gazer.

Mr McLaughlin stated that no other horses were affected by the incident.

Miss Mundy stated that she had made an error of judgment in this instance.

Mr Davidson stated that Miss Mundy had an outstanding riding record, only having received one suspension under this rule in her career of riding. Mr Davidson stated also that Mr Robinson’s mount Surprise Purchase may have contributed to the incident slightly by moving outwards.

Miss Mundy asked the Committee to take into account when fixing penalty of her riding record.

Miss Mundy stated that she was riding between six and eight horses on most race days.

Mr Davidson added that in his opinion the interference was low to mid range of carelessness.

The Committee was satisfied a breach of the rule had occurred and as result the charge was upheld.

The Committee, in fixing the penalty, gave Miss Mundy credit for her guilty plea, and her outstanding riding record. Mr Davidson’s comments regarding Surprise Purchase possibly contributing were also taken into account.

Miss Mundy was suspended from the conclusion of racing on Saturday 24 April 2010 up to and until the conclusion of racing on Saturday 1 May 2010.
