Facts:

An information was filed by Stipendiary Steward, Mr N McIntyre, against Licensed Senior Jockey, Mr R Doherty, alleging two breaches of Rule 330(3)(a) in that...he broke his riding engagements in Races 9 and 10 and was replaced on both horses..

Mr Doherty was present at the hearing and indicated that he admitted the breach.

Rule 330(3)(a) reads as follows:

A Rider shall not:

wilfully or without reasonable cause break a riding engagement.

Mr McIntyre stated Mr Doherty had accepted riding engagements on POACH THE CASH - Race 9 and BIDDEDO - R 10.  Replacement jockeys had been engaged for both horses but the betting public had been inconvenienced by the changes.  He said Mr Doherty had informed the Stewards earlier in the day but was well after anything could be done.  He had had every opportunity as the fields for the meeting were available several days ago.

Mr Doherty stated he was travelling back to Christchurch later in the day and then flying back to Ireland.  When he had re-checked his travel arrangements he realised he could not ride later in the day due to his flight schedule.  He had arranged the jockey replacements with the trainers concerned one he realised the error.

Submissions for Penalty:

Mr McIntyre sough a fine of $100 for each broken riding engagement.

Mr Doherty accepted the submission of the Steward.

Reasons for Penalty:

Mr Doherty had had every opportunity to inform the Stewards of his change of plans.  The submissions of the Stewards are appropriate in the instance.
