Facts:
Following the running of Race 9, the MACAULAY FORD WAIPANGO HANDICAP, an information was filed by Stipendiary Steward, Mr Davidson alleging that B Murray (THE STYLE) used his whip excessively prior to the 100 metres.
Mr McLaughlin, Stipendiary Steward, demonstrated on the videos that the respondent used his whip 9 times on his mount without the necessary respite.
Mr Walsh said it was clear cut. The breach was low end. There were a couple of breaks but Mr Murray did not put his whip away for long enough.
Mr Murray said he had got over-excited as his mount was responding to his urgings at the time. It had got the wobbles on the wet track but he had tried to keep it going.

Mr Davidson produced Mr Murray’s record which he said showed 2 suspensions, one of which was due to drop off tomorrow. The breaches were 21 April and 4 July 2018. He said it was not a high end breach and the starting point in the Penalty Guide was a 6-day suspension.
Mr Walsh said the breach was low end and that a short suspension was appropriate. Mr Murray said he was intending to ride the two days at Blenheim.
Reasons for Penalty:
We agree with the parties that the breach is low end and take a 6-day starting point. We observe that the respondent is a very busy apprentice and has had 257 rides this season. We also give some weight to the fact that Mr Murray was only one day away from the commencement of the reset period.
