Facts:
Following the running of race 4 the Mennies Min Dig Maiden stewards charged Mr P Shaikh (It’stolate) with a breach of excessive use of the whip in that he “…used his whip in an excessive manner prior to the 100m.”
Rule 638 (3) (b) (ii) reads: A Rider shall not:
(b) strike a horse with a whip in a manner or to an extent which is:
(i) unnecessary (ii) or excessive (iii) or improper
The guidelines read: Without affecting the generality of Rule 638(3)(b), a rider may be penalised if their whip use is outside of the following guidelines: Inside the final 600 metres of a race, official trial or jump-out a horse may be struck with the drawn whip up to five times after which the rider must cease their use of the whip for a minimum of five strides before striking the horse again with the drawn whip, with this restriction to apply prior to the final 100 metres. The whip may then be used at the rider’s discretion until the winning post is reached.
Mr Shaikh admitted the charge and appeared at the hearing.
Mr Davidson, with the aid of the videos, stated that in the home straight from approximately the 250 metre mark Mr Shaikh used his whip five times, with a short break, before using his whip again another five times. He said the break between the strikes was only two strides. Mr Tidmarsh said the strikes with whip were repetitious with a short break in between. The use of the whip was a breach of the guidelines and the rule.
Mr Shaikh agreed with the stewards’ evidence. He said he had miscounted the number of strikes and strides.

Mr Tidmarsh said Mr Shaikh had recently entered the senior ranks. He had ridden 106 times this season and 102 times last season. Mr Shaikh had admitted the breach at the first opportunity. However, the breach was his third in the past 6 months. The previous breaches had been dealt with by way of fines, but a third offence warranted a suspension. Stewards were seeking a suspension of seven national riding days.
Mr Shaikh said he had confirmed rides at Riccarton on April 7th. He sought a deferment of any suspension until after the Riccarton meeting.
