As Mr Haruki admitted the breach we find the charge proved.

Penalty:

The committee impose a suspension on Mr Haruki of two South Island Riding Days. The suspension commencing at the conclusion of racing on Monday 21 April 2014 up to the conclusion of racing on Sunday 27 April, effectively the Marlborough Meetings on 24th and 27th April 2014.

Facts:

At the conclusion of race 4 The Insurance Brokers Alliance and Locations Real Estate Handicap an information (A3853) was lodged by Stipendiary Steward Mr M Davidson alleging with approximately 300 metres to run Legal Aid (M Haruki) shifted ground inwards checking Contador (S Muniandy).

The rule reads 638(l)(d): a rider shall not ride a horse in a manner which the Judicial Committee consider to be careless.

Mr Haruki acknowledged he understood the nature of the charge, the rule, and confirmed his admission of the breach.

Mr B Tapper (Mr Haruki’s employer) assisted Mr Haruki at the hearing.

Stipendiary Steward Mr Davidson showed the committee the head on, and side on video clips of the alleged incident, highlighting Legal Aid (M Haruki) shifting inwards when not sufficiently clear of Contador (S Muniandy) at about the 300 metres to run mark.

Mr Davidson stated that Mr Haruki has continued to ride his horse out and did not take any corrective action when it continued to move inwards.

Mr Haruki admitted he had made a clear error of judgement by allowing his horse (Legal Aid) to shift inwards when not sufficiently clear.

Submissions for Penalty:

Stipendiary Steward Mr Davidson stated that he believed the breach was low to mid-range, and that a suspension of two to three South Island Riding days was appropriate.

Mr Davidson also stated that Mr Haruki had one previous suspension at the Gore Meeting on the 30th September 2013 where he received a two day suspension.

Mr Haruki has had seventy seven race day rides this season.

Mr Haruki had no submissions on penalty.

Reasons for Penalty:

The committee considered the evidence carefully, and was satisfied that the breach was low to mid-range of carelessness. The Judicial Penalty guide recommends a starting point of 5 days suspension.

The Committee were able to give Mr Haruki a discount of 1 day for his early admission of the breach, and a further day for the low to mid-range of carelessness. A further one day discount was given to Mr Haruki for his good riding record over the previous 12 months.
