Ms Wynne is suspended from race riding for three days. She does not apply for a deferment and accordingly she is suspended from the conclusion of racing on 17th May 2015 until the conclusion of racing on Saturday 23rd May 2015. That period of suspension encompasses meetings at Woodville (21st), Oamaru (22nd) and Wellington (23rd).
Facts:
As a result of an incident in Race 2, the "Brendon Shearing Contracting/SPG Riverton Maiden", Ms SL Wynne, Apprentice Jockey was charged with a breach of Rule 638(1)(d) of the Rules of Racing. The information alleged that near the 950 metres mark, Ms Wynne allowed her horse "Parker" to shift inwards when not sufficiently clear of "On The Rise" (R Cuneen) which was checked, resulting in interference to "Chancery Lane".
Stipendiary Steward N Ydgren showed the incident to the hearing on the video coverage from two separate camera angles. He pointed out how Ms Wynne allowed her mount to shift in on "On The Rise", when her mount "Parker" was not its own length clear and another length clear. This had a 'concertina' effect in that "On The Rise" was checked back on to "Chancery Lane" (T Moseley), which suffered interference as a consequence.
In response, Ms Wynne acknowledged that she did cause interference to "On The Rise" but she thought that it did overreact and as a consequence, she felt that she was not really responsible for the interference caused to "Chancery Lane". She was supported in this submission by Mr Tyler. Mr Davidson acknowledged this also.
Submissions for Penalty:
Mr Davidson acknowledged that the degree of interference caused by Ms Wynne was at the low end of the scale. He said that Ms Wynne is a leading apprentice, and is sort after by trainers. She has had 360 rides during the current racing season.
However, Mr Davidson advised that this is the fifth occasion during the 2014/15 season that Ms Wynne has appeared on a breach of the careless riding rule. He submitted that a suspension of two days would be appropriate.
In response, Ms Wynne said that she acknowledged that a suspension was inevitable but that she was concerned about riding engagements in the Central Districts which were imminent. Ms Wynne said that Mr Myers had invited her to ride for him in late May. The Committee questioned Ms Wynne in some detail about her connection with Mr Myers stable in order to determine if she was more than 'just a South Island jockey' in order to determine the days on which she would be suspended.
Reasons for Penalty:
This committee is satisfied that Ms Wynne rides in the Central Districts from time to time, and accepts without reservation that she has been invited by Mr Myers to ride for his stable in upcoming meetings. Therefore in setting the penalty, Central Districts days are being taken into account.
Ms Wynne is primarily a South Island jockey. However after factoring in our acceptance of the fact that Ms Wynne does ride in the Central Districts, we nevertheless adopt a starting point of a three day suspension. Notwithstanding Mr Davidson's submission that a two day suspension would be adequate we cannot ignore Ms Wynne's record, even though she has not transgressed in the last five months, and is a 'busy' rider. Her record is an aggravating factor which calls for an uplift of one day, making the starting point a suspension of four days. Against that we allow as a mitigating factors, the low level of carelessness and Ms Wynne's early admission of the breach, which enables us to provide a discount of one day on our starting point.
