--Mr Kharil admitted the breach.
--Mr Davidson stated that Mr Kharil had difficulty with his weight, and it appeared as if it was always going to be difficult for him to ride at 53 kg. Mr Davidson clarified that Mr Kharil had accepted the ride, not his employer, Mr Hamilton.
--Mr Kharil stated that he had attended a seafood luncheon the day prior to the Races and offered no mitigating circumstances.
--Submissions on Penalty
--Mr Davidson stated that Mr Kharil had received no previous breaches under this Rule in the past twelve months, and he recommended a range of penalty from $150 to $200.
--Mr Kharil said he would prefer a fine rather than a suspension.
