As Mr Johnson had admitted the breach, it was found to be proved.

Accordingly, Mr Johnson was fined the sum of $250.

Facts:

Prior to the running of Race 7, the Christchurch Casino Easter Cup, an Information was filed by Chief Stipendiary Steward, Mr J Oatham, against Class A Rider, Mr C Johnson, alleging that Mr Johnson failed to make the contracted weight on PULLYOURSOCKSUP and was replaced in a Listed Race.

Rule 330(3)(c) reads as follows:

(3) A Rider shall not:

(c) fail to ride a horse at the weight at which it is handicapped to carry;

Mr Johnson had indicated on the Information that this breach of the Rules was admitted, which he confirmed at the hearing. He also confirmed he understood the charge and the Rule it was brought under.

Mr Oatham stated that Mr Johnson had been contracted to ride PULLYOURSOCKSUP in Race 7, the Listed race - Christchurch Casino Easter Cup at 53kg and was unable to make the weight. He said that Mr Johnson informed the Stewards after Race 2 that he was not going to be able to make the weight and would have been 1.5 kg over the carded weight of 53kg. Mr Oatham stated that the connections had limited options for a replacement who could ride at the weight and eventually replaced Mr Johnson with Apprentice rider Mr D Danis.

Mr Johnson stated that he had ridden at 53kg recently but due to today being the 4th meeting in a row, he was having difficulty keeping his weight under control without his normal wasting regime.

Submissions for Penalty:

Mr Oatham stated that breaches under this Rule were normally dealt with by way of a MIN with a first offence fine of $100 but as this was a Listed Race, the Stewards determined that an Information be filed. He stated that Mr Johnson had a clear record in regard to the Rule over the recent reset period of 120 days. Mr Oatham submitted that a monetary penalty in the vicinity of $200 to $300 be considered as penalty in this case.

Mr Johnson requested that the Committee take into consideration that he was losing out in a riding fee.

Reasons for Penalty:

The JCA Penalty Guide provides under the MIN system for 1st and 2nd breaches by way of a fine, $100 and $200 respectively. As this was a Listed Race the Stewards filed an Information due to that aggravating factor. After consideration of all factors, including the status of the race, the effect on the connections at a late hour and Mr Johnson’s submissions in regard to having difficulty wasting due to his heavy race day riding commitments recently, we determined that a fine of $250 was an appropriate penalty in this case.
