Decision:

The Committee ruled that horse number 10, NYMPHADORA TONKS, is disqualified for the race.

Facts:

Following the running of Race 4, The Tea House at Riccarton Park Maiden, an information was filed by Chief Stipendiary Steward, Mr J P Oatham, requesting a ruling “in that NYMPHADORA TONKS (K Asano) weighed in 2.5 kilograms light and must be disqualified”.

Rule 648 provides as follows:

(3)-If, on being weighed in, a Rider cannot draw the proper weight (meaning thereby the weight allotted by the Handicapper for his horse to carry and adjusted only by any re-handicap, by having been declared overweight, by penalty or by authorised allowance) the Clerk of the Scales shall allow such rider 0.5 kg and if the allowance is not sufficient to enable the proper weight to be drawn then subject to sub-Rule (4)of this Rule then in addition to any other penalty which may be imposed the horse shall be disqualified for the Race.

Submissions for Decision:

Mr Oatham said that, on weighing in following the running of Race 4, the rider of NYMPHADORA TONKS, K Asano, weighed in 2.5 kilograms light. Mr Asano reported that he had lost a lead bag just after the 800 metres.

The Committee was shown a video replay of the relevant part of the race on which the lead bag could be clearly seen to fall from the horse and onto the track at the 750 metres.

Mr Oatham said that NYMPHADORA TONKS had finished in 6th placing. He said the horse was required to be disqualified pursuant to Rule 648 (3).

Reasons for Decision:

The Committee was satisfied that NYMPHADORA TONKS had lost a lead bag during the running of the race, as a result of which its rider, Mr Asano, had weighed in 2.5 kilograms under its proper weight as defined. The rule requires that the horse shall be disqualified.
