Decision:

Mr Frye’s request for a ruling to late scratch GELATO is denied.

Facts:

Prior to the running of Race 5, the Fern Law Ltd Lawyers Maiden, an Information, requesting a ruling, was filed by Licenced Trainer, Mr D Fyre ruling under Rule 534 (2)as to whether Mr Frye could scratch GELATO without a change in track conditions.

Rule 534(2) provides as follows;
534(2)(a) If, after the scratching deadline (as specified for the relevant Race Meeting in accordance with Rule 510(d)(v) or as amended by NZTR from time to time) on the relevant Race day, a Trainer or an Owner or lessee (as the case may be) or his Agent or its Racing Manager wishes to scratch a horse from a Race he must (whether by production of a veterinary certificate acceptable to the Stipendiary Steward or Page 84 of 194 otherwise) attempt to satisfy the Stipendiary Steward that there are circumstances which warrant the horse being scratched and that he is therefore entitled to scratch it after that time. If the Stipendiary Steward is so satisfied, the Stipendiary Steward may authorise the Trainer or Owner or lessee (as the case may be) or his Agent or its Racing Manager to scratch the horse.

(b) If the Stipendiary Steward is not so satisfied, he shall complete an information and file it with the Judicial Committee and the Judicial Committee shall then determine whether there are such circumstances and whether the Trainer or Owner or lessee (as the case may be) or his Agent or its Racing Manager is authorised to scratch the horse after that time.

Submissions for Decision:

Mr Frye gave evidence that the track today held a bias towards mid to outside track, against inside drawn horses. He said that GELATO, owned by himself, had drawn two at the barrier and had she drawn towards the outside, he would not be before the Committee, seeking to late scratch her. He explained that GELATO would not have the ability to get out of that inside position over the early stages and would not be competitive for the punters and the horse's sake.

Mr Fyre stated that placegetters in the first two races, apart from the 3rd horse in the first race, had drawn out in the running and you do not have to be a rocket scientist to see where the winners are coming from, which was to the outside of the track. He added that any horse drawn down on the inside had compounded over the concluding stages in the first two races. Mr Frye stated that he did not think the filly would be any good on that ground on the inside and did not want to run the horse. He said that if GELATO did not go well today, he would lose a rating point and it could be difficult to get a run in the future.

Mr Davidson stated that the Riders had told him the track was inconsistent but there had been no change in track conditions and unlikely for any upgrade or downgrade of the track. He added horses were doing good times and the Stewards objected to the request to late scratch GELATO as there had not been a material change in track conditions. He added that the 3rd placed horse, VAN HALEN, in race 2, had drawn 2 at the barrier.

Reasons for Decision:

The Committee carefully considered all submissions and evidence presented with this request for a ruling.

This Committee found that Mr Frye had genuine concern for GELATO’S ability to handle the track from an inside draw of two, however, not a lot of evidence that the track was bias to mid to outside barrier draws, as there had been only 2 races and both those were from the 1200m shute. Several place getters in the first two races had raced from inside draws. Mr Davidson stated that the riders had informed him that the track was inconsistent but that they had no intention to upgrade or downgrade the track as would be required for a late scratching to be considered. This Committee ruled that the circumstances presented by Mr Frye did not pass the threshold required for the Committee to consider granting Mr Frye’s request to late scratch GELATO.
