Rule 870 (3) Any horse which breaks from its gait shall promptly regain its gait., Breaking Horses Regulations:, (b) Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its gait., Where a protest has been duly lodged against the placing of an offending horse, the Judicial Committee shall either:, (ii) disqualify it from the race under Rule 1003(2)

Decision:

"Willie Shine" is disqualified from Race 10.

The amended placing are therefore:

1st Horse 7 - "Clifden Clowers"

2nd Horse 10 - "Sarah Palin"

3rd Horse 2 - "Sueno"

4th Horse 4 - "Blue Don"

5th Horse 1 - "Speedy Earl".

Dividends and stakes were ordered to be paid in accordance with amended placings.

Facts:

In the concluding stages of the "Keelah Farm Veterinary Services Trot", "Willie Shine" driven by R Holmes, broke from its gait with  150 metres (approx.) to run to the winning post. It failed to return to its gait, galloping over the distance of 150 metres. It finished in 4th position. The incident was shown to the hearing and explained by Stipendiary Steward Wallis.

Mr Holmes was not present at the hearing but had endorsed the information saying that he did not contest the protest by the Stipendiary Stewards and did not wish to be present at the hearing.

Submissions for Decision:

Mr Renault submitted that there was a clear breach of Rule 870(3) and the Breaking Horses Regulations in that the horse had galloped in excess of 50 metres in the last 200 metres of the race.

Reasons for Decision:

The fact situation was obvious and this Committee was left in no doubt that "Willie Shine" had galloped for at least 150 metres in the final 200 metres of the race, which was a clear breach of Rule 870(3) and the Breaking Horses Regulations.
