Defendant:    Mr RJ Butt  - Junior horseman and driver of  Roving President

--

Hearing:

--

Following the running of race 6, the Islington Tavern Reefton Pace, an Information was lodged against junior horseman, Mr RJ Butt, the driver of Roving President, alleging a breach of Rule 869(2)(a), in that he used the whip excessively in the run home.

--

Mr Butt admitted the breach and elected not to be present.

--

To the committee, Mr Renault confirmed that Mr Butt waived his right for assistance from a senior driver.

--

Describing the breach, Mr Renault referred to the video of the race.   He pointed out Mr Butt’s position (on Roving President) from the turn, and showed that, in the latter stages of the run home, Mr Butt used his whip 19 times without any discernible pause.   The horse finished in 6th placing.

--

This use of the whip in this case, in the stewards’ view, was excessive and, after viewing the film, this was acknowledged by Mr Butt.

--

In respect to penalty, Mr Renault said this was Mr Butt’s first such breach and he recommended a fine of $200.00.

--

Penalty:

--

Mr RJ Butt, driving Roving President, has admitted a breach of Rule 869(2)(a) in that he used his whip excessively.   He is a junior driver, this is his first such offence and he has admitted the breach, and in this case the committee is satisfied the recommended penalty is appropriate.   Mr Butt is fined the sum of $200.00
