Following the running of race 3, the Criterion Hotel Pace, an Information was lodged against CD Thornley, the driver of Jason, alleging a breach of Rule 869(2)(a), in that he used the whip excessively in the run home.

Mr Butt admitted the breach and elected not to attend the hearing.

Describing the breach, Mr Renault referred to the video of the race which showed Mr Thornley using his whip 22 times in the run home, when winning on his drive, Jason. He said the whip was used in an excessive manner with no discernible pause, and clearly outside the guidelines and he reiterated that, when spoken to, Mr Thornley admitted the breach.

In respect to penalty, Mr Renault recommended a fine in the order of $200.00.

In this case, Mr CD Thornley, driving Jason, has admitted a breach of Rule 869(2)(a), in that he used his whip excessively.

It is his first such offence and the committee is satisfied that the recommendation of the stewards is in keeping with other similar breaches. We find a fine of $200.00 is appropriate and Mr Thornley is fined the sum of $200.00.
