Following the running of Race 1, the MS Moore Contracting Handicap Trot, a protest was lodged by the Stipendiary Stewards against horse no 7, Major Domas (RJ Butt), placed 4th by the Judge, on the grounds of breaking from its gait and being lapped on to the 5th placed horse, no 15, Little Tomtom.
The placings were: 10, 11, 13, 7, 15, 12, and the margins were a head, long neck, 1 1/4 lengths and 1/2 head.
--At the commencement of the hearing, the committee was advised that the driver of Major Domas - junior horseman, RJ Butt, assisted by Mr JF Curtin - was representing the connections of the horse, and he did not contest the protest. The Information was so endorsed.
--Explaining the circumstances, chief stipendiary steward, Mr Escott, referred to the video of the race. He showed that Major Domas (RJ Butt) broke in the run home and did not promptly regain its gait. It continued in a break for the last 50metres of the race and, finishing in 4th place, was lapped on to the 5th place horse, Little Tomtom (P Nairn).
--Decision:
--This protest was not contested, and was lodged by the stipendiary stewards against horse No 7, Major Domas (RJ Butt), placed 4th by the Judge.
--As described by the stipendiary steward, and as evidenced by the video, we find that Major Domas, driven by Mr Butt, broke in the run home and continued in a break to the finish line, when it was lapped on by the 5th placed, Little Tomtom.
--We also find that, in breaking prior to the 50 metre mark and continuing in a break for the remainder of the race, Major Domas was in breach of rule 870(3), in that it failed to promptly regain its gait.
--Accordingly, the protest is upheld and, following submissions, we exercise our discretion to disqualify Major Domas from the race.
--The placings are now:-
