Decision:
Following the running of Race 11, the Oceanview Okari Pace, an information was filed by Chief Stipendiary Steward Mr N. R. Escott under Rules 869(4) and (6)(b) and (c) alleging a breach of the push out rule by Mr T. S. Chmiel, the driver of “Brave Wiggy” (7), with about 1100 metres to run.

Following the running of Race 11, the Oceanview Okari Pace, an information was filed by Chief Stipendiary Steward Mr N. R. Escott under Rules 869(4) and (6)(b) and (c) alleging a breach of the push out rule by Mr T. S. Chmiel, the driver of “Brave Wiggy” (7), with about 1100 metres to run.
--Mr Chmiel had indicated on the Information that he admitted this breach of the Rules, and that he did not wish to attend the hearing.
--Mr Escott gave evidence and used video coverage to show that with about 1100 metres to run Mr Chmiel had shifted out into the three wide line on the back of “Bold Jester” (1) forcing “Red Baron”, driven by Mr D. Dunn, to race four wide.
--Penalty:
--Mr Escott advised that the Mr Chmiel had no previous relevant convictions, and as he had admitted the breach a fine of $200-00 was recommended.
--In considering penalty we took into account Mr Chmiel’s clear record and his admission of the breach. We were satisfied that a fine of $200-00 was appropriate, and accordingly Mr Chmiel was fined the sum of $200-00.
