Facts:
Following the running of Race 5, the Criterion Hotel Mobile Pace, an information was filed by Stipendiary Steward Mr N M Ydgren against Open Horseman Mr M Heenan alleging a breach of Rule 869(3)(b) in that he drove carelessly when driving “Augustus Time “near the 300m.
Mr Heenan had indicated on the Information that this breach of the Rules was admitted and he had also informed the Stipendiary Stewards that he did not wish to be present at the hearing.
The charge reads as follows:
I, the above named informant allege that the above named Defendant committed a breach of Rule 869(3)(b) in that you drove carelessly passing the 300m when allowing your horse “Augustus Time to strike the wheel of “Alta Mario” (R Holmes) resulting in your horse breaking and checking “Alta Cleopatra”.
Rule 869(3)(b) reads as follows:
“(3) No horseman in any race shall drive:-
(b) carelessly:-
Submissions for Decision:
Mr Ydgren gave evidence and used video coverage to show that near the 300m Mr Heenan, driving “Augustus Time” when racing in midfield, attempted to come off the back of “Kaiteri Bay”, driven by Mr J Dunn. When shifting out to take up a position on the back of “Alta Mario”, driven by Mr R Holmes, “Augustus Time” struck the wheel of “Alta Mario” and broke. The trailing horse was inconvenienced in this incident although Mr Ydgren submitted that that horse was tiring at the time.
Reasons for Decision:
As Mr Heenan had admitted this breach of the Rules it was found to be proved in accordance with Rule 1111(1)(d).
Submissions for Penalty:
Mr Ydgren informed the Committee that Mr Heenan had a clear record and credit should be given for his ready admission of the breach. Mr Ydgren said that Mr Heenan had driven on 42 occasions this season with 34 drives last season. He submitted that the breach was mid- range as it was only his horse that was affected and the trailing tiring runner inconvenienced.
Mr Ydgren submitted that Mr Heenan had indicated on the Information and to the Stewards that a suspension was preferred. Mr Ydgren stated the Stewards did not have an objection to a suspension and if a suspension was imposed that a penalty of 3 effective days be imposed.

In determining penalty, the Committee took into account Mr Heenan’s ready admission of the breach and his good record. The Committee considered this breach to be mid-range and determined that a suspension would be an appropriate penalty in this case with the length of suspension being 3 days.
