As Miss Moore had admitted this breach of the rules it was found to be proved.

Penalty:

The Committee granted Miss Moore's request for a seven-day deferment until 13 January 2015. We therefore determined that Miss Moore’s Jockeys licence be suspended from the conclusion of racing 13 January up to and including 23 January 2016. This suspension encompasses the days racing at Greymouth on 16 January and Gore on 23 January 2016.

Facts:

Following the running of Race 6, the Molloy & Associates Reefton Cup, an Information was filed by Stipendiary Steward, Mr J McLaughlin, against Class A Rider, Miss B Moore, the rider of OUR PREMONITION, alleging careless riding near the1100m by shifting inwards when not clear of OVER THE RIVER, ridden by Mr K Mudhoo and EL CHICO, ridden by H Bennett with both runners having to be checked.

Rule 638(1)(d) reads as follows:

“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
 (d) careless”

Miss Moore had indicated on the Information that this breach of the Rules was admitted and he confirmed this at the hearing. Miss Moore also confirmed that she understood the charge and the Rule it was brought under.

Mr McLaughlin gave evidence and used video coverage with the assistance of Co-Chief Stipendiary Steward, Mr N McIntyre, to show that approximately 300m after the start, on the turn out of the straight and near the 1100m, Miss Moore riding OUR PREMONITION, was in a 3 wide position and improving forward in an attempt to secure the lead with OVERTHERIVER, ridden by Mr K Mudhoo and EL CHICO, ridden by Miss H Bennett on the inside.

Mr McIntyre explained that Miss Moore had shifted in, in a move to secure the lead and was not clear in doing so. He said that Miss Moore was only a bare length clear not her own length and another length clear as required under the rules when shifting in. He pointed out Mr Mudhoo and Miss Bennett having to check when Miss Moore was shifting in to take up a position on the rails and in the lead.

Miss Moore accepted that she was not clear and had misjudged her inwards movement. She accepted she was not her own length and another length clear when shifting in.

Submissions for Penalty:

Mr McLaughlin stated that Miss Moore had been back riding full time since October 2015 and had a clear penalty record to date. He stated that her record previous was also good. He said that Miss Moore admitted the breach at the first opportunity and combined with her record submitted that a term of suspension be imposed. As to the length of that suspension, Mr McLaughlin said he would leave it up to the Committee.

Miss Moore made no submissions in regard to penalty.

Deferment of penalty was discussed with Miss Moore requesting time to consult with connections in regards to commitments she may have at the Hokitika meeting on 13 January 2016.

Reasons for Penalty:

In determining penalty the Committee took into consideration Miss Moore’s ready admission of the breach, the level of carelessness, which we assessed as mid-range and her good record.

In taking the JCA Penalty Guide starting point of 3 days for a South Island rider we were able to give Miss Moore a discount of 1 day for her admission of the breach and good record. We therefore determined that a 2 day suspension was an appropriate penalty in this case.

After discussions with connections, Miss Moore requested a deferment of penalty for seven days which would include Hokitika on 13 January 2016.
