Request for a Ruling of the Rules of Racing, Rule 330(2) as to whether a dispute exists regarding the declaration of riders for “Show Cat” and “Miss Millbrook” in Race 8.

THE FACTS

--

The parties to this dispute are Mr Neil Coulbeck, a Licensed Trainer of “Show Cat” and Mr Terry Kennedy, Licensed Trainer of “Miss Millbrook”. 

--

Prior to the hearing commencing, an informal discussion was held between Mr Coulbeck and Mr Kennedy and the Panel, and we were advised that an agreement had been reached between them, that Mr Coulbeck would release Licensed Jockey CW Johnson from his engaged ride on “Show Cat” to allow Mr Johnson to ride “Miss Millbrook”.  It is noted that Mr Johnson has ridden “Miss Millbrook” in its last three starts.

However, prior to making an official ruling with regard to the agreement, evidence was heard from Ms Belinda Middlewood, who was acting as Licensed Jockey Mr CW Johnson’s agent.

Ms Middlewood confirmed to the hearing that she was approached by Mr Coulbeck and she had confirmed that CW Johnson would ride “Show Cat”.  Thus, this was a confirmed engagement.

Ms Middlewood went on to say, that she did not know at the time that she accepted the engagement for Mr Johnson, that “Miss Millbrook” would be starting in the race.  She said that she left it “in the lap of the Gods”.

Ms Middlewood said that she knew that “Miss Millbrook” had accepted for the “Miss Scenicland” at Kumara on Saturday 9 January 2010, but was unsure of the  lead-up race, namely the Reefton Cup.

--

She said that she had Jason Laking as a standby for “Show Cat”.  However, Ms Middlewood did confirm that she had not spoken to Mr Kennedy with regard to “Miss Millbrook” at the time that she confirmed the engagement for “Show Cat”.

--

With the trainers concerned having reached agreement over the dispute, our official ruling, therefore, was that Licensed Jockey CW Johnson would be confirmed as the rider on “Miss Millbrook”.  Mr Coulbeck confirmed that, in the circumstances, he would release Mr Johnson from his engagement.
