Following the running of Race 4, the Eureka Trust Handicap Trot, an Information Instigating a Protest was laid by Chief Stipendiary Steward Mr N. R. Escott alleging a breach of Rule 870(3) and the “Breaking Horses” Regulation by “Turbo Pat” (3) which finished 2nd in the race.

Mr M. Jones had advised the Stipendiary Stewards that he represented the

connections of “Turbo Pat” and he had endorsed the Information “I do not contest the disqualification of Turbo Pat”.  Mr Escott used video coverage to show that “Turbo Pat” had broken from its gait at the start of this 2600 metre race, and was still in a break 200 metres later.  The “Breaking Horses” Regulation  provides that any horse which breaks from its gait either at the start or during the running of any race and continues on in the break for a distance of 150 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it failed to promptly regain its proper gait.

            Accordingly “Turbo Pat” was disqualified from its 2nd place.  The amended places are as follows.
