Following the running of Race 6 on the programme, an Information was lodged against jockey, J C Bates, the rider of Live By The Sword. The Information alleged a breach of Rule 871(1)(d) Careless Riding.

Following the running of Race 6 on the programme, an Information was lodged against jockey, J C Bates, the rider of Live By The Sword. The Information alleged a breach of Rule 871(1)(d) in that he allowed his mount, Live By The Sword, to move inwards when not sufficiently clear, causing crowding to Shrkan (L M Robinson) over the concluding stages of the race. Mr Bates admitted the breach.

Describing the circumstances, Mr Ching referred to the video of the race. It showed that, approaching the winning post, L M Robinson (Shrkan) on the inside, ran out of room, caused by J C Bates' mount, Live By The Sword, which finished in 3rd place, moving across and crowding him in the last 2-3 strides, that is, within the last 20-30 metres of the race. Mr Ching indicated that, although it was at an awkward place in the race with the winning post on a bend, Mr Robinson was entitled to the racing room and his taking hold short of the line cost him 4th place in the race.

Regarding penalty, Mr Ching said Mr Bates has an excellent race riding record and has not appeared before the committee over the last 12 months on a charge of this nature. He had admitted the breach, and Mr Ching said there was some mitigation in that horses tend to drift in where the winning post is positioned on the bend. In his view, it was at the lower end of the scale and he recommended a fine in this instance.

Not surprisingly, this recommendation was supported by Mr Bates.

In this case, rider J C Bates appears on, and has admitted, a breach of Rule 871(1)(d) in that he allowed his mount Live By The Sword to move inwards crowding Shrkan (L M Robinson) over the concluding stages of the race.

In determining penalty, we are satisfied this breach is at the lower end of the scale and, in this case, that a fine is appropriate. Mr Bates has admitted the charge, and he has an excellent riding record, for which he should be given credit. We also accept Mr Ching's comment that the awkward positioning of the finishing line is a factor and , while still having to exercise due care of course, that the breach is at the lower end of the scale.

Taking the circumstances and recommendations into account, we are satisfied in this instance that a fine of $250.00 is appropriate.
