Following the running of race 4 on the programme, an Information was lodged against Ms J Cameron, the rider of Cobber Kain, alleging a breach of Rule 858(1)(a), in that she failed to weigh in as required by the Rules, after finishing in 4th place.

The placings were: 1st - 7, 2nd - 2, 3rd - 9, 4th - 1, 5th - 5.

Explaining the circumstances, Stipendiary Steward Mr Ching said that, after finishing in 4th place on Cobber Kain, Ms Cameron failed to weigh in after the race. Approaching her in the jockeys room, she realised her error and admitted the breach. His enquiries indicated she had been distracted by a trainer but, whilst he accepted that, he stated that it is her responsibility to fulful her obligations to weigh in.

Regarding penalty, Mr Ching confirmed Ms Cameron had two previous such charges, one in July 2006 at Oamaru and the other at Wyndham in October 2006, and on each occasion she had received a moderate fine. Given this, and the loss of stake for the owners, he sought a monetary penalty of some substance, a deterrent penalty and, under Rule 523(3), he also sought forfeiture of her riding fee.

Ms Cameron reiterated the comment that she had been distracted by the trainer and explained that he had a ?growl? at her outside the weighing room and, as a result of being totally distracted, she turned around and stomped off without weighing in. She said that, although there were stewards there, she wasn?t stopped. Whilst she accepted that it was her responsibility, she asked the Committee to take into consideration the difficulties the jockeys at these meetings have in getting to weigh in.

Miss Cameron said that, whilst she was hoping for a fine, she also offered to make reimbursement to the owners for the amount lost by them in stakes.

To this, the chairman explained that, unlike the Rules of Harness Racing, where it can be ordered by the Committee, there is no Rule under New Zealand Thoroughbred Racing that empowers the Committee to make such an order as a condition of penalty, and any such decision would be of her own volition.

In this case, Miss Cameron has admitted a breach of Rule 858(1)(a) in that, as the rider of Cobber Kain, she failed to weigh in, as required by the Rules, after finishing in 4th place.

We have had the circumstances explained, and we accept that a distraction occurred from the birdcage through to the weighing room. However, Ms Cameron is a senior rider and the onus is on her, as she has accepted, to weigh in.

The Committee is concerned that there are also two previous instances of failing to weigh in the last 6-8 months, a charge that is not often brought given the number of riders and rides that occur.

We do take on board, as acknowledged by the Stipendiary Steward, that Ms Cameron was distracted but, as a senior rider, there is a responsibility to weigh in. We are satisfied that, in the circumstances, a fine of some substance is appropriate. In this case, she is fined $300.00 and, under Rule 523(3) we order forfeiture of the riding fee.

Mr Ching stated that under Rule 856(1), any horse whose rider is required to weigh in, and does not, shall be disqualified and, accordingly, he sought disqualification of Cobber Kain from 4th placing.

Mr Ridley, the trainer of Cobber Kain, was present for the hearing. Acknowledging the Rule, he accepted that in these circumstances his horse must be disqualified.
