Following Race 5 The Towkay Maiden 1400metres Mr N. Goodwin applied to the Judicial Committee to seek a ruling to determine if Vintage Peak should be declared a starter.

--Ms Johnston, the rider of Vintage Peak, told the committee that her gate simply did not open and that as the other horses left the barrier Vintage Peak smashed his head against the front of the gate and barged it open. The other horses were at least a length in front of her when she finally got away.
--Mr Goodwin showed two views of the start and it was obvious to all present that the gate did not open on terms with the rest of the field. Taking into account Ms Johnston's submissions and the clear video evidence the committee was satisfied that there had been some mechanical failure of the starting stall and that Vintage Peak was prevented from taking an effective part in the race.
--The horse was declared a non-starter.
