Facts:

Following Race 5, Stipendiary Steward, Mr B Jones lodged an Information with the Judicial Committee alleging a breach of Rule 638(3)(b)(ii) in that you (L Hemi) used your whip on more occasions than permitted prior to the 100m.

At the outset of the hearing, Ms Hemi confirmed she understood the Rule and she admitted the breach.

Mr Jones used the videos from the top of the straight to count the number of times Ms Hemi used the whip before the 100m mark. The films clearly showed a total of 9 strikes which is 4 over the well-recognised guidelines.

Submissions for Penalty:

Mr Jones said this was the second breach of the whip Rule for Ms Hemi over the last 12 months. In July 2020 she was fined $300 at Trentham for hitting her mount 7 times and winning the race. Mr Jones said there were no aggravating factors with today’s breach.

Ms Hemi explained that it was a staying race, and she was in the first three as the field turned for home. She was trying to improve her position and used the whip in a backhand manner.

Reasons for Penalty:

The Penalty Guide for Judicial Committees provides the following starting points for breaches of Rule 638(3) (b) (ii):
1st breach - $300
2nd breach - $500
3rd breach - suspension

The Committee considered all submissions. Ms Hemi was over the whip guidelines by 4 strikes and finished in 6th place. She did not gain any advantage by her actions. It was also noted that the strikes were not continuous and not overly forceful. There were no aggravating factors requiring an uplift from the Judicial Penalty Guide.

Ms Hemi was reminded that future breaches will likely result in suspension. Mr Jones informed that the whip Rules were currently under review.
