As Mr Hannam admitted the breach the charge was found to be proved.

Penalty:

Taking into account all of the submissions we fined Mr Hannam the sum of $250.

Facts:

Mr Goodwin lodged an information with the Judicial Committee alleging a breach of Rule 638 (3) (b) in that Mr Hannam used his whip excessively prior to the 200 metres. He showed the head on video of the race from the home turn until the finish. Mr Hannam could be seen to hit his mount with the whip a total of nine times without the required respite up to the 200m mark.

Submissions for Penalty:

Mr Goodwin produced Mr Hannam’s riding record under this rule which showed one charge in March this year and three charges in July 2013. He said this was “not the worst” case of excessive whip use and despite Mr Hannam running 3rd he did not gain any advantage by his actions. The Stewards placed the breach towards the lower end and submitted a fine of $200 was a suitable penalty.

Mr Hannam said he was surprised to be charged and believed that a warning would have been more appropriate under the circumstances.

Reasons for Penalty:

In coming to a decision on penalty the committee had regard to Mr Hannam’s admission of the breach, the manner in which he used the whip, the number of strikes over the guidelines and his record. Today’s breach was towards the lower end and while Mr Hannam did have a spate of whip charges last season he has incurred only one in the last 10 months. For a busy rider we considered this to be a good record however excessive whip use is a negative image for the racing industry and will not be tolerated.
