Jockey J Symes, the rider of BULGINBAAH, in race 9 (The Listed James Bull Rangitikei Gold Cup) was charged under Rule 871 (3) in that he made a celebratory gesture prior to the winning post.

The charge was admitted.

Stipendiary Steward N Goodwin showed the incident on both the head and side on film and believed the gesture was made five strides short of the post.  He felt the incident was minor, the arm was not lifted above his head, but to be consistent a charge was laid.  He informed the committee that Jockey J Symes had just returned to race riding after a break away and felt the incident could be best handled by way of a fine at the lower end of the scale.  He suggested $150.00.  He had no previous charges under this rule.

Jockey Symes agreed that there was an element of excitement brought about with his reunion with BULGINBAAH, the win, and his return to race riding.

DECISION AND REASON

--

We concur with Stipendiary Steward Goodwin that a fine of $150.00 in this case is appropriate.

--

We deem the incident to be at the lower end of the scale and agree that there was an element of excitement brought about by the win, Jockey Symes’ return to race riding and his reuniting with BULGINBAAH, a horse he has had previous success on.

This we believe should be the penalty.
