Mr Neal showed the video where Mr. Walsh, when two or three strides from the winning post, looked across to the grandstand while waving his whip in the air quite extravagantly. Mr. Neal told the committee that Mr. Walsh had a clear record having just returned to riding after a long break. His submissions on penalty stated that first offences of this nature had previously been met by fines in the vicinity of $200.00.

Mr.Walsh said that the rules of racing had changed since he had been riding and that he was not aware of Rule 871 (3). He has requested an updated rule book.
