Mr B Herd was charged under Rule 871(1)(d), that as the rider of Moet's Delight he allowed his mount to move inwards when not the required distance clear, dictating the line of running of Take It Easy (J Parkes) in the back straight and forced Take It Easy down on to Shinko Princess (D Walker)

 Mr B Herd was charged that as the rider of MOET'S DELIGHT he allowed his mount to move inwards when not the required distance clear, dictating the line of running of TAKE IT EASY (J Parkes) in the back straight and forced TAKE IT EASY down on to SHINKO PRINCESS (D Walker)

Mr J Parkes, the rider of TAKE IT EASY was called as a witness to give evidence. He confirmed that his line was dictated to and that he should have called. He was riding a horse that was racing greenly. Mr Herd's mount did come across and he was unsure how far ahead Mr Herd's mount was when he crossed.

Mr Herd asked Jockey Parkes if he was in a little trouble and wanted to hang out. Mr Parkes agreed that this was the case and that he was trying to bring his mount back in.

Mr D Walker, rider of SHINKO PRINCESS, said he suffered interference.    Mr Parkes' mount did make contact with him and he was about half a  length in front.        In reply to a question from Mr Herd, Mr Walker felt that Jockey Parkes did not have control of his mount.

Mr N Goodwin, Stipendiary Steward then showed the available films.

The head-on film showed clearly that Mr Herd's mount jumped quickly from the gates and then moved inwards looking for the inside line.     He informed the committee that he felt Mr Herd's mount, when he crossed, was insufficiently clear and forced Mr Parkes mount down on Mr Walker's mount.     Contact was made at that point.      Jockey Parkes was, in Mr Goodwin's opinion entitled to be where he was.   The side-on films were also shown and these, Mr Goodwin believed, showed Mr Parkes having to take hold of his mount when Mr Herd's horse crossed.

Jockey B Herd showed the available films. He informed the committee that he jumped approximately one length clear of the field. He was entitled to cross from his wide barrier draw. He believed he was at least one and a bit lengths clear and in answer to a question stated that no contact was made by his mount. He believed Jockey Parkes' mount was inexperienced (it was having its first start) and its reaction to his horse coming across contributed to the alleged incident. He felt Mr Parkes was having a difficult ride.

Mr K Hawea, in summing up, informed the committee that Mr Parkes was entitled to his line. Contact between Mr Parkes' mount and Mr Walker's mount was made and this was a result of Mr Herd's actions.

The committee viewed the available films on a number of occasions. The head-on film clearly showed that there was distance between the horses at the point of the alleged incident.    Mr Parkes in his evidence was unsure what that distance was. Contact was made between Mr Parkes and Mr Walker's mounts. The head-on film confirmed that.        The committee was unsure that Jockey Herd's actions in angling his mount inwards was the sole contributing factor in the alleged incident.

Jockey Parkes' mount was racing greenly and its movements could be clearly seen in both films. It was, however, entitled to be where it was at that point in the race.

 DECISION AND REASON

--

Mr Herd you have been charged in that you moved inwards when not the required distance clear.    The head-on film shows clearly that you did come across as you were perfectly entitled to do. The question this committee has to answer is whether you were the required distance clear.      We are of the opinion, after viewing the available films and taking account of the verbal evidence presented that we are unable to determine clearly the distance between the horses at the point of the alleged incident.

Jockey Parkes was entitled to be where he was but his horse was racing greenly.

--

We are of the opinion that there is doubt whether Mr Herd's mount was the only contributing factor in the alleged incident. In view of these doubts Mr Herd the charge is dismissed.
