--Following the running of Race 10, See the New Year in @ the Yaldy Mobile Pace, an information instigating a protest was filed by Mrs K R Williams, Stipendiary Steward, by GUERNICA (T S Chmiel), placed 2nd by the judge, against CRACKER BLACK (C D Thornley), placed 1st by the judge, on the ground of interference in the home straight.
--Mr C D Thornley, driver of CRACKER BLACK, was present at the hearing of the information and he indicated that he was representing the connections of that horse in the protest hearing.
--Rule 869 provides as follows:
(8) The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:
(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses-
immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.
The Passing Lanes, False Rails and Home Straight Regulations provide as follows:
4. In the last lap of any race the the leading horse on the running line shall, upon entering the home straight, maintain as straight a course as possible parallel to the running line and allow the trailing horses full access to the expanded inside lane.
Mrs Williams showed video replays of the final 300 metres of the Race. She pointed out CRACKER BLACK leading into the home straight with GUERNICA trailing it on the pylons. The question to be determined was did CRACKER BLACK protrude into the passing lane denying full access to GUERNICA and was interference, if any, sufficient to warrant relegation of CRACKER BLACK?
--Mrs Williams, referring to the head-on video replay, said that GUERNICA had got up on the inside of CRACKER BLACK. The latter then “possibly ran in slightly”, Mrs Williams said. At all times, Mr Chmiel had a clear run on the inside but would have been required to “momentarily” shift down to avoid Mr Thornley. The sulky wheels of the two runners “locked up”. The obligation of the trailing horse was to move right into the passing lane. GUERNICA was able to be fully driven out to the finish in the final stages, the last 60-70 metres, of the Race, Mrs Williams said. The official margins were margins a ½ length and a nose.
--Mr Chmiel said that, in the straight, CRACKER BLACK had “run in a fraction” and touched wheels but he would not have been able to beat that horse. The horse that finished 2nd, MARLON, had finished fast. He had to stop driving for 2-3 strides but was unable to make up any ground. The interference happened 150 metres from the finish and MARLON “picked him up”. Mr Chmiel admitted that he had plenty of room on his inside.
--Mrs Williams pointed out that the passing lane tapered and CRACKER BLACK had maintained a straight line with the pylon marking the entrance to the passing lane. Mr Chmiel could have moved further into the passing lane. Prior to locking wheels, Mr Chmiel said that he had been “inching up to leader”. His momentum had been affected for a couple of strides but he did not believe that it affected the result.
--Mr Thornley alleged that Mr Chmiel’s horse had moved out fractionally. Mr Chmiel had not gone for his whip at the point where the wheels contacted and, when he did subsequently, Mr Chmiel’s horse was unable to make any ground. Mr Thornley submitted that his horse had maintained a straight line in relation to the pylon at the entrance to the passing lane. The passing lane was a “one horse” passing lane but there was almost room for another horse on the inside of Mr Chmiel. Mr Thornley said that he did not believe that he had entered the passing lane.
--The Committee agreed with Mr Thornley that CRACKER BLACK had not entered the passing line in the home straight and, therefore, the Regulation did not apply. While that horse did shift in fractionally and, possibly, affect the progress of GUERNICA for a stride or two, it was clear from Mr Chmiel’s evidence that the chances of GUERNICA were not affected. The Committee was satisfied that there was a clear run in the passing lane at all times for GUERNICA and that, while it found that CRACKER BLACK did shift in, there was also some movement from GUERNICA at that point.
--The conclusion of the Committee was that any interference was very minimal and, while the progress of GUERNICA may have been impeded momentarily, its chances were not affected notwithstanding the margin of a nose between 2nd and 3rd. Mr Chmiel’s evidence in this regard was quite unequivocal.
--The Committee was not satisfied to the required standard, in all of the circumstances, that a change of placings was warranted. The protest was dismissed and the judge’s placings for the Race stand.
