As Mr Dobbs admitted the breach, the charge was found proved.

Penalty:

Accordingly, Mr Dobbs is fined $500.

Facts:

Following the running of Race 7 an Information was filed by Stipendiary Steward, Mr S Renault, against Licensed Open Driver, Mr L Dobbs, alleging that as the driver of POCKET CALL in the race, “You used your whip with more than a wrist flicking motion”.

Mr Dobbs had signed the Information admitting the breach and stated he was conversant with the Whip Regulations.

Rule 869 provides as follows:
(2) No driver shall during any race use a whip in a manner in contravention of the Use of the Whip Regulation made by the Board.

Effective from 1 November 2020 a medium-level breach, the start point would either be a fine ($500) or a short period of suspension (2 days). Mid-level offending is defined as when a driver inadvertently reverts to the old style (freehand, loose reining and / or more than a wrist flicking motion) and continues to drive in this manner for some distance (50 metres) before taking corrective steps to return to a compliant style of driving.

Mr Renault used the Race video to identify Mr Dobbs driving (POCKET CALL), racing on the rail in mid-field at approximately the 400 metres. He showed Mr Dobbs using his whip on several occasions in the home straight by engaging his elbow and shoulder.

Mr Dobbs agreed with the Stewards’ assessment.

Submissions for Penalty:

Mr Renault said the breach was no less than mid- range and the Stewards were seeking a fine of $500 in consideration of the Penalty Guide

Mr Dobbs had no submission to make on Penalty other than to state he wouldn’t be carrying a whip from this day forward.

Reasons for Penalty:

The Committee determined this breach as mid-range. Mr Dobbs complied on occasions in the home straight but has fallen well short of the requirements under the use of Whip Regulations.

The Committee in assessing the factors of a mid- range breach and Mr Dobb’s first charge under the Rule, considered a fine of $500 would be appropriate in this case.
