DECISION AND REASONS:
Following the running of Race 3, Adam White Farrier & Forge Horseshoes Mobile Pace, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Junior Driver, Mr A E Veint, alleging a breach of Rule 869 (3) (b) in that Mr Veint, as the driver of HIGHLY SPECIFIC in the Race, “drove carelessly when following too closely allowing his horse to race up on to the back of R W Curtin (INDEPENDENT LASS)”.

DECISION AND REASONS:
Following the running of Race 3, Adam White Farrier & Forge Horseshoes Mobile Pace, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Junior Driver, Mr A E Veint, alleging a breach of Rule 869 (3) (b) in that Mr Veint, as the driver of HIGHLY SPECIFIC in the Race, “drove carelessly when following too closely allowing his horse to race up on to the back of R W Curtin (INDEPENDENT LASS)”.

Mr Veint had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The charge was found proved accordingly.
Rule 869 provides as follows:
(3) No horseman in any race shall drive:-
(b) carelessly

Mrs Williams, Stipendiary Steward, showed a video replay of the incident with approximately 1400 metres to run. She pointed out Mr Veint in the one-out line not appearing to have any difficulty driving the horse. He was initially back off the horse in front of it, INDEPENDENT LASS. He then got up too close and his horse struck Mr Curtin on several occasions. As a consequence, Mr Curtin was unable to steer or look where he was going and his horse broke. Mr Curtin lost his position and was, thereafter, forced to race 3-wide.

In determining penalty, the Committee took into account Mr Veint’s admission of the breach and his previous good record.   Mr Veint was fined the sum of $200.
