Mr Cameron’s Open Horseman’s licence was suspended from after the close of racing today up to and including 20 April 2017 – 4 days. The meetings intended to be encompassed by that period are Forbury Park on 13 April, Addington on 15 April, Banks Peninsula on 17 April and Forbury on 20 April 2017.
Facts:
Following the running of Race 5, Oxford Trot, an information was filed by Chief Stipendiary Steward, Mr N M Ydgren, against Licensed Open Driver, Mr I R Cameron, alleging that Mr Cameron as the driver of GIN RUMMY in the race, “used his whip excessively in the final 400 metres”.
Mr Cameron had signed the Statement by the Respondent on the information form indicating that the breach was admitted. Mr Ydgren confirmed that Mr Cameron did not wish to be present at the hearing of the information.
Rule 869 provides as follows:
(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.
The Use of Whip Guidelines (effective from 1 December 2016) provide:
The whip shall not be used more than 10 times in the last 400 metres of a race, otherwise this will be deemed excessive use pursuant to these Guidelines.
Mr Ydgren showed a video replay of the final 400 metres of the race. He pointed out GIN RUMMY, driven by Mr Cameron, last of the six runners remaining in contention as those runners entered the final straight. The horse was then drawn widest on the track and, from that point, Mr Cameron used his whip free of the rein twelve times, the last eight in quick succession, continuous and with some force. Mr Ydgren submitted. Mr Cameron had expressed surprise to the Stewards that the count was that high but said he had just miscounted, Mr Ydgren said.
The Committee noted that GIN RUMMY had finished in 2nd placing in the race, beaten by a nose.
Submissions for Penalty:
Mr Cameron had a clear record, Mr Ydgren said. He drives, on average, once per meeting in the Canterbury and Dunedin regions. When told by the Stewards that they would be seeking a $400 fine, Mr Cameron asked Mr Ydgren if he would inform the Committee that he would prefer a term of suspension to a fine, Mr Ydgren said.
Mr Ydgren referred to the Penalty Guide which suggests a starting point of a 2-days’ suspension for a first breach of the Rule. He said that, in Mr Cameron’s case, that would equate to a $100 fine (adopting the Penalty Guide suggestion that one drive equates with a fine of $50). Mr Ydgren said that he had informed Mr Cameron that Stewards would be submitting for a 4-days’ suspension in this case, to equate with a fine of at least $200. Mr Cameron indicated that such a penalty was reasonable.
Reasons for Penalty:
The Committee acceded to the request of Mr Cameron and conveyed by the Stewards that he receive a suspension rather than a fine. The Committee accepted the submission made by Mr Ydgren that it was appropriate for the term of suspension to equate, as far as possible, with a fine of $300 which he would otherwise be seeking. Having regard to the frequency with which Mr Cameron drives (which we based on 1-2 drives per meeting), a 4-days’ suspension would equate more or less to a $300 fine. On that basis, Mr Cameron will be suspended for 4 days.
