As Mr Cameron had admitted this breach of the Rules it was found to be proved in accordance with Rule 1111(1)(d).

Penalty:

Accordingly Mr Cameron was fined the sum of $200.

Facts:

Following the running of Race 6, the Rangiora HRC Horse of the Year 'Thebestlove' Trot, an Information was filed by Stipendiary Steward Mr S Renault against Open Horseman Mr I Cameron alleging a breach of Rule 869(2)(a) in that he used his whip in an excessive manner over the concluding stages.

Rule 869(2)(a) reads as follows:

“(2) No horseman shall during any race:-

(a) Use his whip in an unnecessary, excessive or improper manner.”

Mr Cameron had endorsed the Information that this breach of the Rules was admitted. Mr Cameron had also advised the Stewards that he did not wish to be present at the hearing.

Mr Renault gave evidence and showed video replays of Mr Cameron driving SPEEDY EARL, when in the lead on the home turn. He pointed out Mr Cameron use his whip in rapid succession 14 times between the 150m and 50m. The Stewards, he said, deemed this to be excessive. Mr Cameron was in breach of the rule because he used the whip in a continuous manner over 100m and failed to show distinct pauses or other methods of alternative action between the whip being used.

Submissions for Penalty:

Mr Renault stated that Mr Cameron had a clear record in regard to this rule. He stated that Mr Cameron had driven on 48 occasions last season and so far this season 4 drives. He also stated that Mr Cameron had admitted the breach at the first opportunity. Mr Renault submitted that a fine of $200 be considered in this case.

Reasons for Penalty:

In determining penalty we took the JCA Penalty Guide recommendation of $300 for a breach of this Rule as a starting point. We were able to give Mr Cameron credit for his clear record for which we were able to give him a discount of $50. We were also able to give Mr Cameron a further discount of $50 for his ready admission of the breach. We therefore determined that an appropriate penalty on this occasion was a fine of $200.
