Facts:

Following the running of Race 1, the Bishopdale/Bush Inn TAB's & Tavern Harewood Amateur Drivers Mobile Pace, Amateur Driver R Sissons (FRANCO CALIPH) lodged a protest alleging interference by Amateur Driver M Hallett (BILLY JACK) by breaching the "Push-out" rule prior to the 1,000 metres mark. Ms Hallett was accompanied by Licensed trainer B Hackett, who advised the hearing that he was authorised to represent the trainers of BILLY JACK.

Mr Sissons alleged in the information that FRANCO CALIPH was pushed out by BILLY JACK with 1,400 metres to run.

FRANCO CALIPH finished in 4th position, and BILLY JACK FINISHED 3rd. The margin between the horses was a neck.

The incident of which Mr Sissons complained of was shown to the hearing by Stipendiary Steward S Renault. He pointed to the positions of the horse involved. Mr Sissons, said that he was, at the relevant time, running two wide, with REDMARO (G Cook) in front. He said that as REDMARO improved, that Ms Hallett pushed him out to the same line as REDMARO and took his spot in the two wide. He said that he was then forced to run the rest of the race in a three wide position. Mr Sissons maintained that if he had retained the line he was on (which was taken by Ms Hallett) that, having regard to the margin of a neck, that he would have beaten Ms Hallett. He said that from his perspective, he should not have been pushed out in the manner he was and felt that he was able to rely on not being pushed out at that stage of the race.

In response, Ms Hallett said that she was confident that Mr Sissons had left a gap prior to her move outwards. She said that Mr Sissons, in her opinion, was following REDMARO out to the three wide position and that she was not responsible for pushing out FRANCO CALIPH as alleged. She was supported in this regard by Mr Hackett.

Mr Renault was asked to give the Stipendiary Stewards' views on the incident. He said that horses cannot be forced wider prior the 1,000 metres mark, (the "push out" rule) but it was his view that it appeared as though Mr Sissons was following the three wide line behind REDMARO. He also considered that Mr Sissons was not pushed out.

Submissions for Decision:

In summary, Mr Sissons maintained that had it not been for him being pushed out in the manner that he was that he would have beaten Ms Hallett for 3rd position.

Reasons for Decision:

Having listened carefully to the evidence and the submissions made, and also having had the benefit of studying the video coverage thoroughly, this committee is not satisfied that Ms Hallett caused interference to FRANCO CALIPH, by breaching the "Push out rule" as alleged. We have formed the view, that Mr Sissons chose to go "on the back" of REDMARO and left a gap in the running line that he had been on, available for Ms Hallett.

Having made that finding, there is no need for us to go on to consider whether FRANCO CALIPH would have beaten BILLY JACK. In order for us to do that, we first need to be satisfied that interference occurred. We have not found that interference occurred.
